Whispeak owns the intellectual property rights, or holds the usage rights, to all items accessible on the site, in particular the texts, images, graphics, logo, icons, sounds and software.
Any reproduction, representation, modification, publication or adaptation of all or part of the items on the site, by whatever means or process, is prohibited without the prior written authorisation of Whispeak.
Any unauthorised use of the site or of any of the items it contains will be deemed to constitute infringement and will be prosecuted in accordance with articles L.335-2 et seq. of the French Intellectual Property Code.
6. Limitations of liability.
Whispeak may not be held liable for direct or indirect damage caused to the user’s equipment when accessing the www.whispeak.io website, resulting either from the use of equipment that does not meet the specifications set out in section 4, or from the occurrence of a bug or an incompatibility.
Whispeak may likewise not be held liable for indirect damage (such as loss of business or loss of opportunity) arising from use of the www.whispeak.io website.
Interactive areas are available to users (the ability to ask questions in the contact area). Whispeak reserves the right to remove, without prior notice, any content posted in that area which breaches applicable French law, in particular the provisions on data protection. Where applicable, Whispeak also reserves the right to hold the user civilly and/or criminally liable, in particular in the case of a racist, insulting, defamatory or pornographic message, whatever the medium used (text, photograph, and so on).
7. Personal data management.
In France, personal data is protected in particular by Act no. 78-87 of 6 January 1978, Act no. 2004-801 of 6 August 2004, article L. 226-13 of the French Criminal Code and the European Directive of 24 October 1995.
While using the www.whispeak.io website, the following may be collected: the URL of the links through which the user accessed the www.whispeak.io website, the user’s internet service provider, and the user’s Internet Protocol (IP) address.
In any event, Whispeak only collects personal information about the user for the purposes of certain services offered by the www.whispeak.io website. The site is not registered with the CNIL as it does not collect personal information.
Databases are protected by the provisions of the Act of 1 July 1998 transposing Directive 96/9 of 11 March 1996 on the legal protection of databases.
8. Hyperlinks and cookies.
The www.whispeak.io website contains a number of hyperlinks to other sites, set up with the authorisation of Whispeak. However, Whispeak is not able to check the content of the sites thus visited and accordingly accepts no liability in this respect.

9. Governing law and jurisdiction.
Any dispute relating to use of the www.whispeak.io website is governed by French law. Exclusive jurisdiction is granted to the competent courts of Paris.
